Pwllheli Trathlon - Terms and Conditions
The following definitions shall apply within these Terms &
Conditions;
"The Event Organiser" - Dreigiau Dwyfor Triathlon club : The
organisation organising and delivering the event is a not for profit,
voluntary organisation promoting the sport of triathlon and multi
sports events in the Gwynedd.
"The Event" - Pwllheli Trathlon to be held on Sunday 15th May 2022 :
The event entered.
"The Participant" - The individual(s) who wish to enter or have entered
the Event via the online entry system.
Dreigiau Dwyfor Triathlon club whose registered office is at Waen
Helyg, Dinass, Pwllheli, LL53 8SR. Dreigiau Dwyfor Triathlon club is
using the Nifty Entries online entry system to manage their event
entries.
1. Participation
· 1.1 The participant acknowledges that participation in the Event is
physically strenuous and will be physically demanding. The participant
acknowledges that he/she is aware of the nature of the Event and
associated medical and physical risks involved.
· 1.2 The participant agrees that he/she is physically capable of
taking part in the Event and agrees to be solely responsible for
his/her actions and the Event Organiser, its officials/officers, agents
or medical advisers are not responsible for any injury or illness that
he/she may suffer as a result of participation in the Event. The
participant accepts that should any medical or physical condition arise
prior to the Event which is likely to affect his/her ability to
compete, the participant will withdraw in accordance with these Terms
and Conditions.
· 1.3 The participant agrees to abide by all applicable rules and
regulations including British Triathlon rules and regulations. Full

· 1.4 The Event Organiser is also entitled to impose Event rules from
time to time which will form part of these Terms and Conditions.
· 1.5 It is each participant’s responsibility to provide and use a
roadworthy bicycle and participants, helmets should meet the British
Triathlon Federation (BTF) standards -"No helmet no race".
· 1.6 At registration, the participant must produce appropriate
photographic personal identification acceptable to the Event Organiser
or his/her BTF membership card.
· 1.7 The Event Organiser reserves the right at any time to remove
participants from the Event or prevent participants participating in
the Event if in the Event Organiser’s sole discretion, it considers
such action necessary for safety reasons or the proper enjoyment of the
Event by other participants or for any other reasonable reason. No
refund of the registration fee shall be made if the participant has
acted negligently, maliciously, with wilful misconduct or otherwise
without due care and attention for the Event, the Event Organiser, its
officials/officers or other participants, so as to cause his/her
removal.
· 1.8 Participants must be 18 years old by or on the day of the Event
or if under 18 years old the participant's parent or legal guardian
acknowledges that he/she has read and accepts these Terms and
Conditions.
2. Completion of Entry process
It is the Participant's responsibility to provide accurate and truthful
information when completing the entry process, any errors in data
entered is the responsibility of the Participant.
If at any point the organiser discovers that the Participant has
provided false or inaccurate personal information, or that the
information provided means that the participant is ineligible to
participate in the Event the Event Organiser reserves the right to
refuse entry or disqualify the Participant, without any refund of the
entry fee or administration fee.
3.
Registration
Details of the registration process are contained within the race
information. It is the responsibility of the
Participants to attend registration during the published times.
Participants are required to attend registration to collect their race
packs, those unable to attend may nominate another individual to
collect their race pack if that individual is in possession of the
entry confirmation email and a form of photo ID of the participant.
Participants must have photo ID (drivers licences, passport, Triathlon
membership card etc) to register for the Event and be issued their race
pack. Race packs will not be posted out, and can only be collected
during the published times. If you do not register for the Event you
will not be entitled to compete.
4. Collection and Use of Data
The participant agrees that his/her personal details will be stored for
the purposes of the Event by the Event Organiser and can be disclosed
to the BTF. The participant agrees and understands that his/her name,
age group (if applicable) and gender will appear in public lists of
competitors and results. If the participant has agreed to apply for a
BTF day membership, the personal details entered for this Event may be
forwarded to the BTF.
A participant acknowledges that their data will be kept for a
reasonable period in accordance with legal requirements and for
administration purposes.
A participant acknowledges that their name will be displayed on the
start list and in the results.
5. Photography
The Event Organiser has the right to use images, photographs and
footage taken by their contracted photographers and employees at the
Event. These images will be used for the purposes of promoting,
reporting and broadcasting the Event, and any other promotion related
to the business activities of the Organiser.
Any individual who does not wish to have their image used by the Event
Organiser for these purposes must inform the Event Organiser via email
no later than one week prior to the Event. Notification closer to, or
after the Event can be made and the Event Organiser will use its best
endeavours to prevent images of that individual being used but cannot
guarantee it.
For events where children under the age of 18 years are competing,
Participants and spectators attendees are required to comply with the
Photography Policy published on the Event website

6. Communication
All communication from the Event Organiser to the Event participants
will be by email only. Please ensure that the email address entered on
the online registration form is correct and the Event Organiser accepts
no responsibility for inaccurate information provided. No race
information will be posted to participants; it will be available from
the Event Organiser’s website before the race.
The Event Organiser will use best endeavours to provide an Event finish
time for each participant however it cannot be held responsible for any
computer result anomalies or any technical malfunctions.
7. Payment
· 4.1 The participant shall complete the Entry Form online and submit
it together with payment of the fee online in accordance with the Event
Organisers' website. The participant shall not be eligible or entitled
to participate in the Event until full payment of the fee has been
received by the Event Organiser. No payment shall be deemed to have
been received until the Event Organiser has received cleared funds.
8. Transfers and Withdrawals
If a registered participant is unable to compete in the Event, the
participant can transfer their entry to another via the online entry
system, this is only available until 20 days before the event after
which no transfers or refunds are available.
If a participant needs to withdraw from the Event after entering please
use the online entry system to cancel a portion of your fee will be
refunded according to the refund policy on the event web site.
If you cancel:

Up to 8 weeks before the race: 75% refund
· Between 8 and 4 weeks before the race: 50% refund
· Between 4 weeks and 21 days before the race 25% refund

Less than 21 days before the race: No refunds
9. Event Changes
The Event Organiser reserves the right to change the Event without
prior notice for reasons outside of the Event Organiser’s control or
otherwise. This includes alterations to the Event to include fewer
disciplines whether decided by the BTF referee or by the Event
Organiser. In the event of this occurring refunds or transfers will not
be available.
10. Cancellation
If the Event is cancelled for reasons beyond the Event Organisers
control, including without limitation fire, storm, act of terrorism,
"act of god", serious medical incident, then the Participant will not
be entitled to any refund or compensation of other losses and any
refund that the Event Organiser decides to make will be within the
absolute discretion of the Event Organiser.
11. Limitation of Liability
Participation in the Event is at the Participant's own risk. The
Participant irrevocably agrees to hold harmless, indemnify and
reimburse the Event Organiser from and for any sum, costs or expenses
(including legal and professional fees) incurred, payable or paid by
the Event Organiser to any person (including the Participant and/or any
of the Participant's insurers) in connection with any accident, loss,
damage or injury (including death) arising out of the Participant's
attendance at and participation in the Event or any part thereof
(except where any such injury or death is caused by the negligence of
the Event Organiser or any of its employees) and the Event Organiser's
liability to the Participant is excluded to the fullest extent
permissible by law.
Other than as stated below, the Event Organiser shall not be liable for
any loss, damage or expense arising from an event of Force Majeure. The
Event Organiser, its staff, agents or contractors shall not be liable
for indirect or consequential loss or damage.
The Event Organiser will not be liable for any computer result errors
or any technical malfunctions. Whilst the Event Organiser takes every
care with staging the event, the Participant acknowledges that personal
accident and personal items insurance is his/her sole responsibility.
The Event Organiser shall not be liable to the Participant for any loss
or damage of or to personal equipment belonging to the Participant, or
any indirect or consequential loss or damage whatsoever arising out of
the Participant taking part in the Event; or for any loss of business;
revenue or profit; loss of reputation; anticipated savings or wasted
expenditure; pledges made on your behalf or by you to charity.
The Event Organiser will not be liable for any actions of any
spectators or other third parties.
12. Responsibilities
· 9.1 Participants must agree to obey the rules of the race and the
highway code at all times, the cycle course is on mainly open roads
with some partial closures however there are road users and pedestrians
which may be on the course and all participants must ensure they are
aware of all other road users at all times.
13. COVID Cancellation
In the event that we have to cancel the race on the advice of Local or
National Government for COVID restrictions then we will do the following:
- We will not order any Medals, goody bag items etc until we are sure we
can deliver the race, in the event of cancellation we will refund 100% of
the race entry fee (booking fees are not refundable) less any costs that we
have incurred in procuring items for the race.
- Where items have been procured that are not reuseable, or costs incurred
that cannot be recovered these will be deducted from the race entry fee
before any refunds.
- In the event that we are unable to procure items in time for the race due
to uncertainty around COVID then we will refund all race day attendees a
portion of the race fee that would have been spent on the items missing.
14. Statement of Autonomy for 16-17 Year Olds
Young People aged 16-17 years old are assumed to have autonomy over their
decision making and do not require written parental permission to enter an
event. However, by entering this event you confirmed that you have
consulted with your parent/carer/guardian and they are aware of your
participation and entry into this event.
15. Our commitment to you
We will respect your personal decisions, and allow you to make your own
decisions about what exercise you can carry out. However, we ask you not to
exercise beyond what you consider to be your own abilities.
We will make every reasonable effort to make sure the Event is organised to
accepted safe operational standards for you to enjoy.
We will make all reasonable steps to ensure first aid is available at the
Event to an industry standard. If you tell us you have a disability we will
consider what adjustments, if any, are reasonable for us to make to enable
you to participate.
